Terms of Service

1. Acceptance of Terms

By installing or using Brand Studio ("the App"), you agree to these Terms of Service. If you do not agree, do not install or use the App.

2. The Service

Brand Studio is a Shopify app that helps merchants generate brand-consistent product and collection imagery using AI image generation models. The App is provided on an "as is" and "as available" basis.

3. Eligibility

You must have an active Shopify store and be authorized to install apps on that store. By installing the App, you represent that you have such authorization.

4. Subscription and Billing

• The App offers a Free tier with a lifetime cap and paid subscription plans with monthly generation quotas.
• Paid plans are billed through Shopify's managed billing system on a recurring monthly basis. By subscribing, you authorize Shopify to charge your store for the applicable fee.
• Credit bundles are a one-time purchase and are also processed through Shopify's billing system.
• Plan changes take effect immediately; unused credits from the previous billing period do not roll over unless explicitly stated.
• You can cancel at any time by uninstalling the App. No refunds are provided for partial billing periods.

5. Usage Limits and Fair Use

Each plan has a monthly generation quota. We enforce per-minute rate limits to prevent abuse. Attempts to circumvent these limits — including automated scripts, multiple accounts, or credential sharing — may result in immediate suspension.

6. Your Content

• You retain ownership of all product images, brand assets, and prompts you submit to the App ("Your Content").
• You grant us a limited license to process Your Content solely for the purpose of providing the service — generating images, saving them to your Shopify product listings, and enforcing usage limits.
• You are responsible for ensuring you have the rights to any content you upload and that it does not infringe on third-party copyrights, trademarks, or privacy rights.

7. Generated Images

Images produced by the App are generated by third-party AI models (Google Gemini; optionally OpenAI if you provide your own key). Generated output may reflect the training data and behavior of those models. You are responsible for reviewing generated images before publishing them to your store.

8. Prohibited Use

You agree not to use the App to:

• Generate or distribute unlawful, defamatory, harassing, or infringing content.
• Generate imagery depicting real people without their consent, or imagery intended to mislead or impersonate.
• Reverse-engineer, decompile, or attempt to extract the source code of the App or its underlying models.
• Interfere with or disrupt the App's servers or networks.

9. Third-Party Services

The App relies on third-party services including Shopify, Supabase, and AI model providers. Your use of the App is also subject to their respective terms. We are not responsible for outages or changes in those services.

10. Termination

You may stop using the App at any time by uninstalling it from your Shopify admin. We may suspend or terminate your access if you violate these Terms or engage in abuse. Upon termination, all your data is deleted within 48 hours per our privacy policy.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or produce any particular result.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE THREE MONTHS PRECEDING THE CLAIM.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the App or email. Continued use after changes constitutes acceptance of the updated Terms.
